1. Who provides the service
WorkLogTracker is a service of RMTracker S.L. (brand name RMTracker Solutions), with CIF B88803085 and address at Avenida de Andalucía 36, Local 2, 29793 Torrox (Málaga), Spain. The complete identifying data is in the legal notice.
2. Object
These terms and conditions govern the contracting and use of WorkLogTracker, a time recording and work parts application. Contracting the service means accepting them.
The service is aimed at companies and professionals. It is not a consumer service.
3. Registration and accounts
Whoever creates a company in the application becomes the owner of that account and declares to have the capacity to bind the company they represent. The owner registers the rest of people and assigns them a role.
Each user is responsible for safeguarding their credentials. Accounts created by the company require changing the initial password on the first access.
Price
The service is charged per occupied place. Each active person in the company occupies a place, except the account owner, who does not occupy any. A suspended person stops occupying a place from the moment of suspension.

The owner chooses the modality person to person and can combine them. The applicable tax type depends on the customer's country and is calculated by the payment gateway at the time of collection.
Prices may be reviewed. An increase will be communicated with at least thirty days in advance and will not affect a period that has already been paid; if it is not accepted, the subscription can be cancelled before it comes into effect.
5. Free trial
All new companies have fourteen days of trial without needing to enter a card. During the trial period, the service is fully available. When finished, an active subscription is required to register new people.
6. What happens if payment fails
If the account stops being up to date, it is blocked to add new people new. It does not block signing in or checking your own history.
This is deliberate. Keeping track of hours worked is a legal obligation for the employer, and suspending this function due to non-payment would expose the client to fines and without the proof that they are required to keep. A failed payment also grants seven days of grace before taking effect.
7. Cancellation
The subscription can be cancelled at any time from within the app. The cancellation takes effect at the end of the period already paid, without refunding the corresponding amount. After cancellation, the customer can export their record in the formats offered by the application.
8. Customer Obligations
- Inform your staff, and if applicable, your representatives, about the recording system and the use of location at the time of signing in, according to article 90 of the LOPDGDD.
- Keep the data of registered people up to date.
- Do not use the service for purposes other than those intended or contrary to law.
- Be responsible for the content you enter into the application.
9. Availability
RMTracker S.L. takes reasonable measures to ensure that the service is available continuously, without compromising a specific availability percentage unless expressly agreed in writing. Maintenance stops may be carried out during periods of low activity.
The app works offline: sign-ins are saved on the device and synchronized when recovered, so that a service outage does not prevent signing in.
10. Data Ownership
The data entered by the customer is theirs. RMTracker S.L. only process it to provide the service, according to the privacy policy, and does not use it for any purpose. The processing that RMTracker performed by the client is governed by the Annex I of the treatment order, which forms an inseparable part of these terms and conditions.
11. Responsibility
RMTracker S.L. is responsible for direct damages caused by breach of these terms and conditions, up to the amount paid by the client in the twelve months prior to the event that gives rise to liability. It is not liable for consequential loss or indirect damage.
None of the above limits liability in cases where the law does not allow it, such as fraud or gross negligence.
The correct keeping of the time sheet register is the employer's responsibility. WorkLogTracker is the tool with which it is kept.
12. Suspension and termination
RMTracker S.L. may suspend the service if it detects a use that puts the security or integrity of the platform or the data of other clients at risk, notifying the client unless urgency prevents this.
13. Modification of these terms and conditions
The terms and conditions may be modified. Substantial changes will be communicated with at least thirty days' notice, and if they are not accepted, the client can cancel without penalty before they come into effect.
14. Applicable law and jurisdiction
These terms and conditions are governed by Spanish law. The parties submit to the courts and tribunals of Málaga capital, with express waiver of any other jurisdiction, except where the other party is a consumer.
