Developed and operated by RMTracker S.L.
1. What is this application and who provides it
PolizaTracker it is an application developed by RMTracker S.L., with NIF B88803085, whose registered address and data are listed in the Legal Notice of RMTracker Solutions.
Now, you have not contracted it with RMTracker: it is provided to you by your insurance broker, who publishes it under their own brand and has registered it. There is no open registration or payment on your part for using the application.
By using the application, you agree to these terms.
2. The most important thing: this app does not replace your policy
This is what should be made clear above all else:
- The document that obligates and gives you rights is your insurance contract, as signed with the insurance company, along with its general, specific and special conditions. What the application shows —coverages, deductibles, limits, expiration dates— is a presentation of this information so that you can consult it conveniently.
- In case of discrepancy between what you see in the application and what your policy states, the policy prevails. No RMTracker neither through this tool, nor their brokerage, extend, reduce, or modify any coverage.
3. Emergencies: do not report them here
If you have an emergency, call by phone.
Declaring a claim in the app sends it to your insurance company, which processes it during their business hours. It is not an immediate notification channel or a 24-hour emergency service. For an ongoing accident requiring roadside assistance, a developing home incident, or any situation that cannot wait, use the assistance phone provided by your insurance company or broker, which the app itself shows you, and of course, 112 if there is a risk to people.
In all cases, comply with the deadlines and communication methods for reporting an incident that your policy and Law 50/1980 on Insurance Contracts require. Using the application does not exempt you from these.
4. Your account
- Access is personalThese credentials are his/hers and should not be shared.
- The invitation you receive from your real estate agent expires. If it expires, ask for a new one.
- Inform your insurance company as soon as possible if you suspect that someone has accessed your account.
- You are responsible for the accuracy of the information you provide, and in particular, the data from an accident report.
5. Correct use
By using PolizaTracker you agree not to:
- Accessing or attempting to access data belonging to other clients or other brokers.
- Uploading documents that are unrelated to your policies or claims, or contain illegal content or infringe the rights of third parties.
- Presenting false statements or documentation. In addition to constituting a breach of these terms, it may result in the loss of compensation and liabilities provided for in the Insurance Contract Law.
- Interfere in the operation of the service, nor attempt to circumvent its security measures, nor automate access.
Regarding the documents you upload: you retain ownership of what you provide. You authorize us solely to store and make them available to your insurance agency, which is the recipient of these documents in order to process your policy or claim. Nothing more.
6. Budgets and pricing
The prices you obtain through the rate calculator are non-binding estimates, calculated using the data you provide and subject to acceptance by the insurance company. They do not constitute an offer of contract or obligate anyone to insure under those conditions.
7. Service availability
We strive to ensure that the application is available continuously, but we cannot guarantee that it will function without interruptions or errors. There may be downtime for maintenance, updates, or other reasons, such as a failure of the hosting provider or your connection.
Practical consequence: If the application is not available when you need it, the traditional channels remain open. The phone and email of your broker will continue to exist regardless of this app's existence.
8. Responsibility
- From his brokerage: the advice, processing of their policies and claims, and the accuracy of the data contained in the application. He is your point of contact.
- From the insurance company: the coverage contracted and the payment of any compensation that may be due.
- Of RMTracker: the operation of the tool.
RMTracker does not intervene in the insurance relationship or in decisions regarding a claim, and does not respond for them. Nothing in the above excludes or limits the responsibilities that the law does not allow to be excluded, nor the rights that correspond to it as a consumer.
9. Intellectual property
The application, its code and its design belong to RMTracker S.L. The brand, the logo and the colors with which you see it belong to your brokerage. You are granted a personal, non-exclusive and revocable right of use, limited to the purpose described in these terms.
10. Duration and cancellation
Your access lasts as long as the relationship with your brokerage remains. You can cancel at any time from within the application, in Profile → Delete my account, or from the account deletion form of this website, with the scope and limits that explains the Privacy Policy.
Canceling the application does not cancel any policy nor interrupts the processing of an open claim: they are different things. To cancel an insurance, go to your brokerage.
Your brokerage may revoke your access if it ends the relationship between you, and RMTracker may suspend it for a serious violation of these terms or compromise the security of the service.
11. Changes in these terms
Versions are recorded with their date of entry into force. If a change affects you significantly, you will be informed through the available contact means.
12. Applicable law and claims
These terms are governed by the Spanish law. If you are a consumer, you may proceed to the courts in your area of residence, as recognized by consumer protection regulations.
Complaints about insurance services —advice, claim processing or coverage—
should be addressed to the customer service department of your broker or insurer,
and if applicable, to the General Directorate of Insurance and Pension Funds. Issues related to the functioning of the application can be communicated to
